I have an update on this after speaking with the Notary.

If i give up my residency before the five years is up I am liable to pay back the tax saving i made when purchasing the house. Unlike when you sell, there is no sliding scale, you will be liable for the whole lot.

As we maybe back soon anyway i think i will leave it for now but thanks to everyone who offered advice.
